One can’t fault State Representative Jill Chambers for lacking ambition–she’s definitely one of the highest profile legislatures in the state capitol. This morning, I heard on the radio that she is proposing some massive updates to our current open records laws. From what I read, it sounds like good stuff. Here’s what she had to say about it on Peach Pundit:

The purpose of this project is to make this statute crystal clear so that anyone who reads it can understand the law. Of all the laws in Georgia, the Sunshine laws should be easy to understand.

I hadn’t planned to comment on this any more but Chris posted a comment on ONA (pertinent sections reprinted below) in which she admits to filing a fraudulent or incompetent Campaign Contribution Disclosure Report. These are not minor typos – Chris admits to several major omissions: no listing of the $216 qualifying expenditure, no details on the payment in kind $760, and apparently no disclosure of a $1,000 contribution.

Which was it Chris, fraud or incompetence?

And yet you continue to falsely accuse me of hiding contributions when it has been proven that I did not. How do you justify attacking me when your own actions were so egregious? If a clerical error resulting in a late charge from last year’s campaign means I am ‘bad for Doraville’, where does this leave you?

I grew up in a military family and know a little about integrity and honor. Chris mentions her service as an Army officer, so she knows the honorable course is to publish an apology at the very least. Sadly, this is very unlikely.

I’ve tried to set an example of positive campaigning, but Doraville is tired of Chris’ attacks and bullying. Someone very close to her is disillusioned and communicating with us, so we are prepared to respond to her campaign. Exposure is the only way to put an end to this disgraceful behavior once and for all.

That isn’t in kind Chris. That was a donation and $1000 from anyone, including yourself, must be listed. There isn’t $1000 listed anywhere from you or= anyone else.

Sorry Chris, you paid for your qualifying during the period this report was for as, well as paid yourself, and NONE of these or other contributions are on this form. You OBVIOUSLY were waiting till AFTER the election to show who is paying you all this money for rosetta stone and these expencive fliers trashing your opponent with lies.

You had to have Chris as you filed that $716 amount which, on the line you put it on, explains you MUST list where it came from which you refused to disclose. Who did pay you that? We still don’t know. Also you just admited you gave $1000 yourself, which you also ignored to include on this report. Who is paying for these fliers? Or is that to come out AFTER the election?

You obviously filled this out wrong (benefit of the doubt) and instead of admitting you made a mistake, you backed yourself into a corner and are lashing out. You can do no wrong, is that it? Instead of saying or looking into that you did this report wrong (again benefit of the doubt), you blast me with your “as usual you are wrong” insults. Is this what we will have to deal with if you are elected? The inability for you to -look- at anyone else’s point of view or to have the ability to admit you could have made a mistake? It’s plain to anyone this wasn’t filled out correctly and you trying to claim -this is all done right- looks like you’re trying to hide something now.

So let’s take stock of Chris Campaign so far.

Flyer #1′s first lie falsely accuses me of moving to Doraville ‘to run for office’. I had no intention of pursuing political office until drafted to replace Jason Anavitarte who withdrew from the state house race. And Chris knew I already lived in the district before moving to Doraville, I didn’t have to move anywhere.

The second lie implies I will ‘employ an extremely negative campaign”. While voters talk about you all the time, up to now I’ve seldom mentioned you at all. I haven’t needed to. Looks like that’ll have to change.

Last, that I’m a crony of Tom Hart. Repeating a lie over and over does not make it true.

And I’ve already covered the second flyer.

When I see political flyers like the one below, I assume that the candidate thinks voters are stupid:

I’ve been pretty much on the fence regarding who I to vote for in the Northwoods race between Avers and Roche. Each one is a strong candidate, and each has his or her share of flaws. I like that Chris is passionate about the city and its future, but I don’t like that she tends to discount any viewpoints that are different from her own. I like that Bob is diplomatic and reasonable, but strongly disagree with his views on the redevelopment of downtown.

Ultimately, what I want is a city council that can work as a team. I want people who can respect each other even if they disagree, and who will be able to move the city forward. I’m tired of petty bickering and personalities that get in the way of good government. If Chris’ flyer is indicative of how she’ll get along with other council members once elected, I am frankly concerned.

The questions the AJC asks are pretty generic (or just plain silly), but I think the more information voters can get about the candidates, the better! Read all their responses here.

Open Letter from Mayor Ray Jenkins to all Doraville Residents

Dear Doraville Residents:

Recently, you likely received an alarming letter from a member of the Doraville City Council about City issues, including the all-important 911 system. Personally, I have great issue with a Council Member who takes it upon themselves to send an unwarranted, misleading and undeniably false accusatory letter without first advising myself as Mayor, fellow Council Members and the City Attorney. Had we been advised about the content of this alarmist letter, we would have taken immediate actions to advise the residents of the misleading nature of the letter. In short, the letter served no public purpose. Rather, it caused concern where none was warranted

911 system

The most disturbing portion of the letter pertained to the effectiveness of our 911 system. As Chief John King reported at the October 15, 2007 Council Meeting, Doraville has an effective 911 system which is fully staffed by our police department. The Doraville Police Department has an outstanding ‘on scene’ average response time of approximately 2 minutes. Moreover, each of our officers are trained in CPR and as First Responders. One officer is a fully qualified EMT whom the City has equipped with a patrol car and life saving equipment; few cities of any size can make such a claim.

Forfeiture Accounts

Both State Law and Federal Law provide a clear directive of the manner in which confiscated funds may be used, and provide that the management of those funds is the responsibility of the Chief Law Enforcement Officer. Significantly, those forfeiture accounts are audited by two separate and independent auditors and a full report is made to the Council yearly. Unanimously, each current council member has voted approval of these audits.

Open Records Requests

Doraville’s ordinances regarding “copies upon request” permit the City to charge a reasonable cost for copies. However the same Council Member who sent this alarmist letter to you, has bombarded the City with numerous costly document requests, the estimated production cost of one request alone exceeding $21,000

Therefore, at our October 15, 2007 Council Meeting, we directed the City Attorney to draft an ordinance amendment to require that even city officials who make excessive document copy requests, will be required to pay reasonable costs.

Meetings with Council Members

Finally, let me clarify past instances where council members have asked that I meet with them in a group. Georgia law will not permit this without first posting notice of said meeting. Therefore, when I was asked to meet with three Council Members about Chief King, I respectfully declined to meet in this manner. Instead, I offered to meet with each of the three individually, at which point they refused.

It is my hope that this letter puts these issues to rest. The malicious and ridiculous damage that has been created by several council members over the last few months has been an embarrassment to us all. It needs to come to an end now. I urge any resident who has further questions about these or other issues to contact me. Let’s continue to make Doraville “A Great Place to Live.”

This afternoon, when I got home, there were 2 flyers in my mailbox from Bob Spangler (one for each voter in my household). It appears that he is attempting to appeal directly to the voters in an effort to thwart the recall effort that is chugging along against him. Here’s the full text of the flyer:

Dear Neighbor,

Soon you may be approached to sign a recall petition to remove me from office. As your elected Councilman, it is my responsibility to protect and carry on the business of the people in Doraville. I take my responsibility to you very seriously and am willing to stand up for what is right regardless of the consequences to me. Please take time to hear the truth about me, from me.

This is about doing what is right for our community. My actions represent the feelings of many of our neighbors that are afraid of the consequences if they speak out or stand up for themselves, especially against someone that appears popular and powerful.

It’s your right to know the facts!

In late May 2007, I contacted our Mayor to discuss several very serious concerns that I had with the Chief of Police concerning himself with political issues of the city, intimidation of City Council members and Citizens, and lack of neighborhood patrol. The Mayor refused a meeting with me, even on his own terms.

The Recall petition sets forth four alleged acts of misconduct by me. I want to address these as follows:

    911: The failure of our 911 system endangers the life and health of everyone in our City. It serves only a 3 and 1/2 mile area. Under Chief King’s direction, Doraville instituted and continues to maintain an inferior 911 system. Doraville does not house our own Fire Dept. and EMT service; therefore, we are unable to offer immediate EMT and Fire Dept. Services. As your elected official, I am responsible to protect the people. If you call Doraville 911 with a medical emergency, you will explain the situation to the operator; they will then call DeKalb County to explain the situation, and then pass you through to answer more questions from DeKalb County. If your family member were having a heart attack, are you willing to add an extra 5-10 minutes to the arrival of help?
    We need an independent study to guide Council and the City in what direction or changes we should make to our 911 system.

    Executive Session: We went into Executive Session to discuss personnel matters which was approved by the majority of the Council members. No objection was made to our proceeding in Executive Session by our City Attorney or City Clerk; both are to advise us when a topic may be inappropriate for discussion in Executive Session by Georgia Law. Personnel matters, pending litigation or the purchase of real estate are the only subjects permitted in Executive Session. There was no violation of the law of the Executive Session held by City Council on August 6, 2007 to discuss personnel matters with Chief King.

    Open Records Request: During the August City Council meeting, Chief King made several questionable statements. In order to check the facts, I made several open record requests to obtain the necessary and pertinent information for those statements. Unfortunately, I was quoted over $21,000. These records have never been provided to me. In the past, open records requests have been fulfilled at no charge by policy of the City.

    Forfeiture Accounts: State law & City Ordinance mandates how all purchases are to be made on behalf of the city which shall be done by bid and request for proposal. This assures that the City gets the best price for products and services and minimizes fraud and collusion in city purchases. City Council has the oversight responsibility to assure all funds are used as required by law.
    We are aware of banking accounts being maintained by the Chief of Police of forfeiture funds. Our City Ordinance requires that all banking accounts are to be maintained in the office of the City Treasurer, who is the City Clerk. My endeavor as City Councilman has been to protect monies and property which belongs to our city and not the Chief of Police.

I stand up for you as a councilmember and I trust you to do what is right in this recall effort.
